A group of Nevada residents filed a class-action lawsuit last week against BP America and Atlantic Richfield Co. over an abandoned toxic mine. The lawsuit claims local drinking wells have become contaminated with “uranium, arsenic and other metals” and that the companies concealed the amount of contaminants that were leaking off the mine site. Snow Blowers recall 154

Product Liability is another area of San Diego Personal Injury Law.

The Consumer Product Safety Commission has issued a recall of 1,500 snow blowers due to laceration risks. Ariens and Liquid Combustion Technology, LLC said the “snow blower’s engine is missing a safety shield above the side mounted electric starter, posing a laceration hazard to consumer’s fingers.” There have been no injuries reported with the product.  San Diego personal injury attorney Staff Report, PR Newswire  02/17/2011

Witness threatened by prosecutor 153

Premises Liability is another area of San Diego Personal Injury Law.

A New York man has filed a $150 million lawsuit against Brooklyn prosecutor Michael Vecchione, claiming he threatened a witness with violence in order to gain false testimony to convict the plaintiff of the 1995 murder of a rabbi. The plaintiff was released from prison last year after it was discovered that Vecchione did in fact win the conviction by coercing false testimony. Athlete falsely accused of bullying 152

A former Virginia high school athlete has been awarded $5 million by a local jury in a libel lawsuit against the Virginian-Pilot newspaper. Upsher-Smith Laboratories, Inc. Product Liability 151

Upsher-Smith Laboratories, Inc. has announced a recall of one lot of their Jantoven® Warfarin Sodium 3mg tablets. The recall was issued after it was discovered that one of the bottles actually contained 10mg tablets. The Ethicon unit of Johnson and Johnson (J&J) has announced a recall of 700,000 vials of a liquid wound sealant and also a hernia-treatment product. Ikea Product Liability 149

The Consumer Product Safety Commission has announced a recall of around 26,000 SNIGLAR cribs sold by IKEA. Police officer plants a gun on a parolee 148

The city of Oakland has agreed to a $300,000 settlement in a lawsuit claiming that a local police officer planted a gun on a parolee, sending him to jail for almost two years. According to the lawsuit, the plaintiff was arrested while at a funeral and charged with numerous weapons charges, although the gun found belonged to someone else. “This was an important case for holding the police officers accountable for their misconduct,” the plaintiff’s lawyer told the San Francisco Chronicle.  San Diego personal injury attorney Henry K. Woman harassed by a courthouse deputy 147

A former Los Angeles County Superior Court spokeswoman has filed a lawsuit against the Sheriff’s Department, claiming she was physically harassed by a courthouse deputy even though she had the proper credentials. Officer shoots mentally ill man 146

A Mississippi jury has awarded $23 million in a lawsuit over the near-fatal shooting of a mentally ill man by an off-duty Jackson police officer in 2007 near a local Marriott. The suit claimed the officer used deadly, unnecessary force on an unarmed man for no reason.
